1. Definitions

“Formula Matrix”  

means the formula matrix issued to [us] by an Insurer for the purpose of calculating insurance premiums for the insurance it offers through our Website;

 

“Insurer”                                   means a corporate body or entity listed on our Website for the purpose of promoting and offering online insurance policies to Users;

 

“Us”                                            means CompareIN Limited, a company duly incorporated and validly existing under the laws of Nigeria with RC number 1112227; 

 

“User”                                        means a person, corporate body or entity looking to purchase insurance through our Website;

 

“Website”                                means our online price comparison insurance web portal known as Compare Insurance with web address www.compareinsurance.com.ng.

 

2. Use of this Website

2.1          Please read our terms and conditions carefully prior to using our Website as it sets out the important terms which govern our relationship with you in relation to the use of our Website.  By using our Website, you are agreeing to these terms and conditions.  If you do not wish to be bound by these terms and conditions you should not use our Website;

 

2.2          We reserve the right to change these terms and conditions from time to time and such changes to the terms and conditions will apply to your use of our Website from the date they are posted on the Website.  If you do not agree with the changes to the terms and conditions, you are entitled to stop use of our Website at that time;

 

2.3          Any copying, transmission or distribution of the content of or the publications in our Website, particularly the insurance prices contained herein is expressly prohibited;

 

2.4          You are only to use our Website for lawful purposes;

 

2.5          You are prohibited from doing anything that will compromise the operation of our Website or which adversely affects the use of our Website by other Users;

 

2.6          You will indemnify us against all and any loss, damage or expense howsoever incurred by us arising from any non-observance by you of any of these terms and conditions.  In addition, and without prejudice to any other remedy that may be available to us hereunder, in the event that you breach any of these terms and conditions, you will as soon as practicable and at your own cost remedy any such breach.

 

2.7          Where you fail to observe any of your obligations, we reserve the right to take action against you, including barring you from the Website and initiating legal proceedings against you.

CompareIN Limited is a company duly registered in accordance with the laws of the Federal Republic of Nigeria with RC number 1112227, having its principal place of business at Glass House, 25 Karimu Kotun Street, Victoria Island, Lagos. 

 

4. Our Service

4.1           We are an online price comparison platform for insurance products. 

 

4.2           We do not sell insurance, nor do we advise or recommend which policy you should buy, but we will simply offer you the lowest prices available to us and you can then take a decision on which policy best suits your needs;

 

4.3           In the event that a claim needs to be made by you, we will, through our Call Centre and Online claims notification, guide you through the process of filing a claim.  We however do not guarantee that any claim filed by you will be settled by the Insurer from whom you purchased the insurance, nor will we negotiate with the said Insurer on your behalf.

 

5. Users

5.1 You are required to respond truthfully, accurately, and disclose all facts, in relation to any information requested from you, in order to enable us to source and provide you with the most suitable and accurate quotes.

 

5.2           Where you fail to provide truthful, accurate and complete information:

5.2.1      This may void the policy you purchased and you will not be able to make a claim on such policy;

5.2.2      you may not be entitled to a refund of the premium paid;

5.2.3      you may have to pay additional premiums under your policy to reflect any increased insurance risk as a result; and/or

5.2.4      you may be liable for damage or loss to a third party if you cause an accident.

 

5.3           You are also required to inform us and the Insurer of any material changes to your details during the life of your policy, including at renewal.  Insurance is based on the information that you give to the Insurer, and if this changes your premium might go up or down.  In the event that you fail to disclose any material changes to your details, the Insurer will be entitled to refuse your claim.  The Insurer may also be entitled to keep any premium you have paid.

 

6.  Quotes

6.1           The premium payable by you is determined in accordance with the Insurer’s Formula Matrix and the information submitted by you;

 

6.2           The Insurer may change its Formula Matrix, and where it does so, such change of Formula Matrix shall be communicated through a revised price on our Website; 

 

6.3           Where you choose to purchase a policy from an Insurer through our Website, and a premium quote is generated, such quote shall be valid for a period of 14 days (inclusive of the day on which the quote is generated).

 

7.  Call Centre and Online Claims Notification

7.1           Our call centre will:

7.1.1      handle your enquiries;

7.1.2      guide you through the process of purchasing a policy through our Website;

7.1.3      guide you through the process of filing a claim;

7.1.4      address any complaints you may have with respect to your use of our Website;

 

7.2           Our call centre will be available to assist you between 9am-5pm;

8. Exclusions and Limitations

8.1           We are not responsible to you:

8.1.1      for any policy purchased through our Website;

8.1.2      for any potential claims on a policy purchased through our Website;

8.1.3      for any failure to perform our obligations under these terms and conditions caused by matters beyond our control, howsoever arising;

8.1.4      for any losses you suffer as a result of the use of our Website;

8.1.5      for any losses you suffer where the information you submitted to us is not truthful, accurate and does not disclose all the facts;

8.1.6      for any losses you suffer as a result of any inaccuracies in the Insurer’s Formula Matrix;

8.1.7      for any losses you suffer as a result of negligence on the part of the Insurer;

8.1.8      for any losses you suffer as a result of your dealings with the Insurer;

8.1.9      for any losses you suffer as a result of the insolvency of the Insurer;

8.1.10   for any losses you suffer because you cannot use our Website at any time;

8.1.11   if our Website is unavailable at any time or for any period;

8.1.12   for any technical, factual, textual or typographical inaccuracies, errors or omissions in our Website;

8.1.13   for any misrepresentation on our Website (other than a fraudulent misrepresentation made by us);

8.1.14   for any unauthorised access or loss of personal information that is beyond our control; and

8.1.15   for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

 

9.  Data Protection

We will comply with all applicable data protection legislation in force in Nigeria with respect to the personal data provided to us by you.

 

10. Severability

10.1        If any provision of these terms and conditions is rendered void, illegal or unenforceable in any respect under law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby;

 

10.2        These terms and conditions will only apply as between us and you.  Unless otherwise stated in these terms and conditions, no other person may benefit or rely upon these terms and conditions.

 

11.   Termination

11.1        We may issue a warning, suspend (temporarily or permanently), or terminate your right to use this Website if you:

11.1.1   Substantially breach any of these terms and conditions;

11.1.2   Infringe or violate or attempt to infringe or violate any rights of any other User(s) of this Website and/or third parties in connection with this Website;

11.1.3   If you are using this Website to commit or attempt to commit a criminal offense.

 

12.  General

12.1        These terms and conditions and other policies posted on our Website constitute the entire agreement between us and you, superseding any prior agreements;

 

12.2        Our failure to enforce or delay in enforcing any particular provision does not constitute a waiver of our right to do so later;

13.1        We own or are the licensee of all intellectual property rights (including without limitation all patents, registered designs, registered trademarks and any applications for such registered rights, copyright, database rights, unregistered design right, unregistered trademarks, trade or business names (including internet domain names) and all other rights of a similar nature or having equivalent or similar effect or similar effect to any of the foregoing contained on our Website or contained in materials published on our Website.  The works are protected by copyright law.  All such rights are reserved;

 

13.2        You may copy, or download the content and other downloadable items on our Website for personal and non-commercial purposes only.

 

14.  Governing Law

These terms and conditions and other policies posted on our Website shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
